Terms of Service

1. Acceptance of Terms
By accessing or using IEP Casemate ("Casemate," the "Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. Casemate is operated by Vaccaro Ventures LLC.
2. Description of Service
Casemate is a special education compliance intelligence platform for educators, schools, and districts. Depending on your plan and configuration, the Service may include: caseload organization; SDI scheduling and service-delivery logging; goal progress monitoring; IEP meeting preparation; AI-assisted drafting and document extraction; interactive student practice generated by an educator; AI tutor sessions launched by an educator for a selected IEP goal; and school/district early-warning views (Monitor, Audit-Ready, Command). The Service is provided as-is and may change over time.
Certain features create unique share links (for example, student practice or AI tutor sessions, family or collaboration links). Those links allow a recipient to use a limited, feature-specific experience without creating a Casemate account. Anyone who has the link can access that experience until it expires or is closed by an authorized user.
3. Account and Eligibility
You must create an account to use educator, school, or district features of the Service. You are responsible for maintaining the confidentiality of your credentials. You represent that you are an educator or otherwise authorized to use the Service for educational purposes. You must be at least 18 years old to create an account.
Students and other recipients who open an educator-created share link are not required to create an account. Account holders are responsible for how those links are created, shared, and revoked.
4. Acceptable Use
You agree to use the Service only for lawful educational purposes. You will not:
- Share your account or credentials with others.
- Use the Service to violate any law or regulation.
- Attempt to gain unauthorized access to the Service or other users' data.
- Use the Service to transmit malware or harmful code.
- Resell or redistribute the Service without permission.
- Enter student full names, Social Security numbers, dates of birth, home addresses, or other unnecessary personally identifiable information where the product is designed for initials and de-identified records.
- Use AI tutor, practice, or other generative features to seek or produce content unrelated to the instructional purpose you selected, or to circumvent school policies.
- Share practice or tutor links more broadly than needed for the intended student or instructional setting, or leave active links available after they are no longer needed when you have the ability to close them.
5. Artificial Intelligence Features
Some features use generative AI (including document extraction, drafting of progress or present-levels text, practice generation, and AI tutor sessions). AI output can be inaccurate or incomplete. For educator-facing drafts (for example, progress statements or meeting materials), a qualified professional must review and finalize content before relying on it for IEP decision-making or official records.
AI tutor and practice sessions are instructional tools under the direction of the educator who launches them. They are not a substitute for specially designed instruction delivered by a qualified professional, and they do not create an independent educational determination.
6. Your Data and Privacy
You retain ownership of the data you enter. Our use of your data is governed by our Privacy Policy. By using the Service, you consent to that policy. Additional detail for privacy officers is in our Trust Center.
7. FERPA and Student Data
Casemate is designed to minimize student data: caseload records use initials rather than full names, plus goals, services, schedules, and related instructional or progress information you enter or generate in the Service. If you are a school or district employee, you are responsible for ensuring your use complies with FERPA and your agency's policies, including how share links are distributed. We may enter into Data Privacy Agreements (DPAs) with schools and districts upon request.
8. Subscription and Payments
Some features require a paid subscription. Fees, billing cycles, and refund policies are disclosed at the time of purchase or in your school/district agreement. We may change pricing with notice. Continued use after a price change constitutes acceptance, except where your written agreement provides otherwise.
9. Termination
You may close your account at any time. We may suspend or terminate your access if you violate these Terms. Upon termination, you may request a copy of your data; we will delete it within 30 days of a valid request unless we must retain it for legal reasons or under a school/district agreement.
10. Disclaimers
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE ERROR-FREE, UNINTERRUPTED, OR SECURE. CASEMATE IS A TOOL TO ASSIST EDUCATORS. YOU ARE RESPONSIBLE FOR THE ACCURACY OF YOUR DATA, YOUR REVIEW OF AI-ASSISTED OUTPUT, YOUR DISTRIBUTION OF SHARE LINKS, AND YOUR COMPLIANCE WITH APPLICABLE LAWS.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, VACCARO VENTURES LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM.
12. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms and updating the "Last updated" date. Continued use after changes constitutes acceptance.
