Terms of Service

1. Acceptance of Terms

By accessing or using Casemate ("Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. Casemate is operated by Vaccaro Ventures LLC.

2. Description of Service

Casemate is an IEP case management tool for special educators. It helps you manage caseloads, generate schedules, track service delivery, and produce progress reports. The Service is provided as-is and may change over time.

3. Account and Eligibility

You must create an account to use the Service. You are responsible for maintaining the confidentiality of your credentials. You represent that you are an educator or authorized to use the Service for educational purposes. You must be at least 18 years old to use the Service.

4. Acceptable Use

You agree to use the Service only for lawful purposes. You will not:

  • Share your account or credentials.
  • Use the Service to violate any law or regulation.
  • Attempt to gain unauthorized access to the Service or other users' data.
  • Use the Service to transmit malware or harmful code.
  • Resell or redistribute the Service without permission.

5. Your Data and Privacy

You retain ownership of the data you enter. Our use of your data is governed by our Privacy Policy. By using the Service, you consent to that policy.

6. FERPA and Student Data

Casemate is designed to minimize student data: only initials, goals, services, and schedules are stored. If you are a school or district employee, you are responsible for ensuring your use complies with FERPA and your district's policies. We may enter into Data Privacy Agreements (DPAs) with schools upon request.

7. Subscription and Payments

Some features may require a paid subscription. Fees, billing cycles, and refund policies will be disclosed at the time of purchase. We may change pricing with notice. Continued use after a price change constitutes acceptance.

8. Termination

You may close your account at any time. We may suspend or terminate your access if you violate these Terms. Upon termination, you may request a copy of your data; we will delete it within 30 days of a valid request unless we must retain it for legal reasons.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE ERROR-FREE, UNINTERRUPTED, OR SECURE. CASEMATE IS A TOOL TO ASSIST EDUCATORS. YOU ARE RESPONSIBLE FOR THE ACCURACY OF YOUR DATA AND YOUR COMPLIANCE WITH APPLICABLE LAWS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VACCARO VENTURES LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms and updating the "Last updated" date. Continued use after changes constitutes acceptance.
